

Mary Miller is an experienced litigator focusing on complex trial and appellate litigation in state and federal courts. She has represented clients in matters involving antitrust, fraud, breach of contract, class actions, misappropriation of trade secrets, false advertising, and the False Claims Act. Mary previously first chaired a federal jury trial to successful verdict, and she has authored numerous motions and briefs at all stages of litigation.
Before joining Lehotsky Keller Cohn LLP, Mary was a partner at Kirkland & Ellis LLP in Washington, D.C. Mary previously clerked for the Honorable Justice Samuel A. Alito, Jr. of the Supreme Court of the United States, Judge Priscilla Richman of the United States Court of Appeals for the Fifth Circuit, and Judge Richard J. Leon of the United States District Court for the District of Columbia.

Representative Experience
Dangaard v. Meta — Defended Meta in putative class action alleging unfair trade practices. Obtained summary judgment for Meta on all claims.
Represented major technology company in significant Section 2 antitrust case.
Kaplan v. Carrier — Represented Carrier in putative nationwide class action relating to product-liability issues.
United States ex rel. Streck v. Eli Lilly — Represented Lilly on appeal from jury verdict in False Claims Act case.
AMO Dev., LLC v. Alcon LenSx, Inc. — Won summary judgment motion for Alcon in a patent and copyright lawsuit concerning laser eye surgery technology, limiting available damages based on the copyright statute of limitations. The case was settled prior to trial.
Force v. Facebook — Obtained affirmance on appeal in the Second Circuit of two related actions against Facebook brought under the Anti-Terrorism Act. The result was profiled in The American Lawyer.
Friends of the Earth v. Sanderson Farms, Inc. — Secured dismissal for Sanderson in action challenging "100% Natural" advertising.
Alabama Aircraft Industries, Inc., et al. v. The Boeing Company — Represented The Boeing Company in a suit alleging misappropriation of trade secrets arising out of the United States Air Force's award of a multi-year contract to Boeing; successfully briefed motion to enforce the parties' limitation of liability provision, eliminating over $100 million in damages.
Godwin v. Facebook — Obtained dismissal of negligence action against Facebook asserting failure-to-warn and wrongful-death claims. The result was affirmed on appeal.
Conduent Business Services LLC v. Cognizant Business Services — Represented Cognizant in a dispute alleging breach of contract and fraud.
