Rick Eberstadt is an appellate and trial litigator with experience at every level of federal and state court, particularly in cases involving constitutional law and statutory interpretation. 

Before joining Lehotsky Keller Cohn LLP, Mr. Eberstadt served as Deputy Solicitor General in the Office of the Virginia Attorney General, where he represented the Commonwealth of Virginia in high-stakes and high-profile litigation. Mr. Eberstadt prevailed at oral argument in several cases before the U.S. Court of Appeals for the Fourth Circuit, and worked on approximately one hundred cases in which he authored or edited briefs submitted to federal and state courts, including to the United States Supreme Court, the Fourth Circuit and other federal courts of appeals, and the Supreme Court of Virginia. In this role he also advised Virginia legislators and agencies on the legality of potential state action. 

Mr. Eberstadt previously worked as an Associate at Steptoe & Johnson LLP, where he authored legal briefs and assisted with litigation discovery. While there he also prevailed in family court trials in which he managed all aspects of the trials to successfully represent his pro bono clients.

Mr. Eberstadt clerked for Judge Raymond M. Kethledge on the United States Court of Appeals for the Sixth Circuit, and for Judge Robert J. Conrad in the United States District Court for the Western District of North Carolina. Mr. Eberstadt received his J.D. and his B.A. from the University of Virginia, where he served as the president for multiple debating organizations.
